If more visa numbers get implemented thru recapturing from previous years, I think it will be a fun day since USCIS is now processing cases from Dec 01, 2004 !

Upon reaching the RD, Any information here on whether USCIS would process the I-485 and would wait for availability of visa numbers to approve the I-485 ? If so, I guess we would eventually see various I-485 getting approvals simultaneously, the day visa numbers advance. Of course visa numbers may advance only in the year 2050 :-)

The theory is that they process the case but not approve as there are no VISA numbers aavaliable.

The theory is that when they touch your case the LUD changes.

My question is that Did anybody see any LUD change prior to pending Dec 2004 cases.

I think they're more likely to just "sit" on a retrogressed case till numbers are available.

I doubt they care to work on such cases.

Their thought process might be like this ......
In any case, numbers may not be available for a long time ..... so what's the use in processing the cases now ? I mean they would need to re-check stuff like validity of the employment offer(EB) / marriage(FB) before approval again -- so its more work for them to do it now !

I would be happy to hear otherwise -- but having seen NSC do absolutely nothing when the numbers were current, I really don't have any expectations from them.

Someone who applied at TSC reported an RFE eventhough he is from a retrogressed country. Good luck guys!

If the retro continues..very soon the processing dates for NSC I-485 may even outpace current calendar dates ;)

You mean in December 2005, they will show processing June 2007 cases?

:D -- Quite possible !!

and then they can happily claim that the "backlog reduction effort" is a huge success !!
Maybe all of this retro was to "help" them accomplish those goals
