NSC is still not moving at all

any action plan can you think of? I have brought up older thread
for Mr. Khanna's attention. He has asked us to remind him in two weeks and it is already two weeks.
 
I am not sure who (which IIO) to trust...

...someone else posted that he / she was told by an IIO that it is taking 23 mos!!!

Which one is correct? [Though it still sounds long, but given a choice between the two - I am willing to take 21 - having already spent 18!]

As a side note...
Any one with experience of having applied for renewal of a 3rd set of EAD and (or) AP? What are the recent times of processing EADs and APs? Please post.

When it comes to IIOs, the best thing is to take everything they tell you in stride. Different information from different individuals. The smart ones (or is it the dumb ones?) don't even tell you anything to cover themselves! The information is often incorrect. My guess is that I485s will take anywhere from 21-24 months. It will of course vary on the individual.

On your other question, I recently received an EAD (1st one not a renewal) based on my I485 application. I filed in December 4, 2002 and the petition was approved on May 24, 2003. After 90 days, I did go to the local BCIS office and got an interim card that was also valid for 90 days. From what I read in this forums I765 applications are taking 3-4 months. Mine seems to be an exception (interstingly it took this long even though no RFEs were generated).

Guys. I was told 23 months. But the officer also told me that processing times could vary.

However since I have filed I have only seen these times go up. It is still saying 450-480 days in my online status. But going by the pain that 2001 filers are still going through only GOD can help us out of this.

All the late 2002 filers like me might as well forget about our green cards for the next 3 years and just keep using the EAD and think it is like Green Card.

I think this will only get worse in future because most people in this country have become anti immigration anyway !!!!

Somebody should ask the IIOs, why the hell is it taking so long and what are they doing to see to it that the timeline doesn't inflate even further ?? :mad:

Is this a cyclic process ? I remember my seniors telling me that a few years back it used to take a lot of time to clear the I-485 stage, and then suddenly they started processing things really fast and everything was current again.

Not sure if this is cuz of 9/11 or just no one caring enough till things get really bad !!

I agree with Ghee , some thing needs to be done about this.

Everyone agrees that they (IIIOs?) SHOULD be questioned (as to why is it taking so long)! But who will bell the cat?

Maverick, I understand that we are all frustrated. But may I ask, could you ask that question?

a quick question for you: when you walked into a BCIS office for your EAD card, did you remember them asking for proof that you had applied at least 90 days ago? in my case, i didn't keep a copy of my filing and was wondering if there's any other way i could convince these guys if i have to get the card. thanks, orca.

Didn't mean to suggest that any one amongst us should ask the IIOs , don't want anyone to take on the wrath of any Govt. official , especially an IIO.

I have quite a few problems with the processing times already , don't want to invite any more :p

What I was suggesting that , we have a collective and organized way of doing this .. maybe Rajiv can help us here.
 
A couple of years back ISN (Immigration Support Network) used to be very effective in lobbying for people like us. I am not sure if they are that effective anymore. A lot of good came out of their lobbying efforts. We need something like that put together. I hope AILA gets more involved and tries to get us some answers. I hope that there was some way that lawyers like Rajiv Khanna, Sheila Murthy and other lawyers who genuinely care about us to come together and do some lobbying.

If nothing is done the time frame is only going to get longer and longer because nobody cares about immigrants anymore specially after Sept 11th.
 
I talked to an IIO this afternoon and also got that 21 months info. Basically what he can do is reading the website for me, I asked even in NSC AVM that my RFE was confirmed to be received then why this 800 still just saying sending out RFE? He doesn't know either. Another result from this call is my expiring FP, he said there's a chance that I don't need to do it again(how sweet would that be), or if I need to do it again I don't need to pay for that.

Ok, I am waiting for the miracle before FP expiriation or in two months according to IIO.

Yes, I did have the I765 receipt notice and I volunteered it since it was past 90 days. I would suggest 2 things:

1. If your case was filed by a lawyer, he or she may have gotten a courtesy copy which you could ask for.

2. If you don't have your courtesy copy, do you know the receipt number for your EAD application? Try taking that as well as your I485 RN, any old EAD you have, your passport with the I94 to the local BCIS. They can (and in my case did) look up your information on their computer, so you may still be able to get an interim card.

did you have to pay the application fee again to get the interim EAD? or it was issue on the basis of your renewal application?

actually, my H1B transfer is pending for 7.5 months, and they let you work for 8 mths (ie, 240 days) past the pending date. i'm VERY worried that my paycheck will stop. i have applied for my EAD myself - but have moved quite a bit since, and have mislaid it; and no, i don't remember the RN. i'll try to get together my previous expired EAD, H1B transfer pending notice and 485 RN and see if they'll be good enough to issue it. in any case, this is another of those disgusting situations that we're supposed to pay for for their macabre callousness.
