Now I am concerned.... AP question

I plan to travel to India with my wife End of this year.
MY RD:11/06/2001.
Wifes RD: 04/12/2002

I am going to apply for AP soon.
I intend to stay in India for 3 weeks and my wife for 8-9 weeks.
Does Duration cause a problem during re-entry to US.
I am hoping i see my approval before i leave.
any comments, suggestions.

Assuming u r using EAD (and not H1B), u ought to have AP for travel.

Given the dates for travel u have provided, ur wife and u shouldn't have any problems in re-entry with AP.

Both my wife and i have our EAD's.
Hopefully, i will nto have a problem.
Will be carrying:
.I-485 receipt Notice.
.EAD
.AP
.Company letter
.Pay stub.

Am i missing any thing.
 
Fisa, here is the answer.

You can go to India.

If you/your wife come back with in the expiry of your H1B/H4B

Then you don't need to show your AP.

If your H1B/H4B expired... Then you need to show your AP.

Check for expiry date on your AP...

You can come back any day before expiration date of AP.

I spoke with attorney. So... I am 100% positive.
