 Guys,

I have a Masters from US and have 2 years of experience. I have an option of starting my GC processing from my current company, the only issue is that the in the LCA, the employer is going to mention Bachelors + 2years experience. I guess I do not qualify for EB2.

Do you guys advise I start GC with this company (i heard about the national processing centers and backlog reduction .. can someone briefly explain what they mean? Is it going to take longer time for getting the labor approved?) or do I just wait for PERM to be implemented and apply through a different company later on? (Is PERM that bad as it is made out to be?)

Ask them if you can add Masters or Bachelors with 2 years. Then better make sure the job duties are suitable changed. Talk to your company and tell them you would have to wait a very long time before you become a LPR.

In order to go under EB2 category, min job requirement must be (MS+0) or (BS+5 yrs of progessive experience.)

Ask your company lawyer to make the minimum job requirement MS+0 or BS+5 yrs of progressive exp. Since you already have MS+2, you will fall under EB2 category.

Also, note that your salary for EB2 must be high enough. (Otherwise prevailing wage detemination (PWD) by DOL for EB2 may cause a problem). PWD depends on your job title and DOL's survey of local job market.

All above qualifications and experience should prior to joining this company. The experience gained with GC sponsoring company cannot be counted for GC process.

Nope.. They are not very flexible and do not want to add masters in the job requirements. Its either BS + 2 or nothing.

So comin back to my first q. Do i apply with this co.? or wait for PERM and apply with a different company? Can anyone throw some light on advantages/disadvantages?

TIA
