Nov 17, 2003 EB3 I-140 - Approved

I got my I-140 approval on Jan 6th, 05. Got email this morning.

I-140/I-485 was filed concurrently on Nov 17, 2003 (took approx 13 months+)
I-485 is still pending approval.
Received second EAD and AP approved.

Are you sure the substitute labor caries the date of filing I140 as PD. On my I140 approval based on sub labor, the PD is mentioned as original PD and not the date of my I140 RD. Please clarify?

Dude, As a matter of fact, it is not.

If you have Sub Labor then, Receipt of your 140 is going to be your PD.

It's a different story that CIS centers (Particulary VSC) are not following that way. But, as per LAW they have to.

ideally, your 140 application should be not be affected by the retrogression of dates , only 485 processing should stop.
