I never heard of that before, cant find any information online. But I had to fight with this officer(the typical officer who picks after the regular reps escalate the call) that I talked to over the NCSC phone line, and he keeps on telling me to go to the office and tell them to move your files from one office to the office near to your new residence. Otherwise they can deny my application?

Does that occur to any of you?

Do they make laws at their own will without telling anyone?

I though AR11 and calling USCIS number takes care of everything.

Send a letter

I am in the same boat. Passed my N400interview back in 05 ans stuck on name check hole. I did move to a different state and was told that I would need to go to my new local office to request my file to be transfered (by an IO on the phone).
I did go to my new local office and was asked to send a letter to my old office and ask them to transfer my file.
I did send a request, and still waiting.

Is it not easier if you sue USCIS rather than becoming an unpaid file chaser on their behalf with no guarentees if that will work? You could spend another year or more in this limbo situation unless you take control of the situation and sue USCIS. This forum has all the resources for anyone who can read simple English to do it on their own.

If the files are not their and the local district claims that we are not responsible for his lawsuit, then the judge can dismiss the case....i guess.

what do u think?

i have done change of address and all but telling them to move files from one office to another......isn't that suppose to be their duty?

True, they are supposed to forward your file just like they're supposed to adjudicate our files lol. It's up to you, you can either send the a letter to request your file to be transfered or wait 10 to 12 months for them to actually do it (and that's if you're lucky enough to be remembered ). BTW, did you file your 1447(b) yet? and I saw another thread where you mentioned something about 2nd interview, were you called for a second one??

no second interview yet. But I am in the preparation of filing lawsuit before it get 2 years.

if it says on the manual, then i will go to the office and request files to be transfered. Otherwise I will see them in court . what do u say?

There is no manual that says such thing but per 3 IOs that I have talked to already, they all suggested to send a letter. I would not wait till I sue to not complicate things more then they're already complicated.
So it is a new law now that they schedule for 2nd interview after 2 years?? I had my first more than 30 months ago.
