Notice to est. Communication with nvc but already in us??

Hi, I my husband and I (married to USC and in the US out-of-status) took adivce of a lawyer n filed I-130 separately :confused:, having found out we shoud've just filed concurrently :( I was about to send out I-485 when I recieved notice that I-130 was approved and almost immediately after a notice to "establish communication with the National Visa Center and register your agent". I'm a little confused about why I need to do that? I still need a Visa number even though I'm already here? And do I go ahead send in my AOS package after I've contacted the NVC or am I supposed to wait again for a visa number? PLEASE HELP! THANKS!
 
File I-485 immediately with the copy of I-130 approval letter, once you receive the reciept for that go to your local USCIS office with I-130 approval and the reciept of the I-485 and they will directly request the NVC to send the file to them.
BTW that attorney that gave you that advice is dumb and stupid.

We're def sorry we took that advice but were so nervous about making mistakes...now determined to finish this right. THANK YOU so much for helping, we really appreciate it.
 
Do not walk into a USCIS office without getting the receipt for the I-485 filing as once filed and a receipt in hand, you are not considered out of status but awaiting Adjustment of Status.
I am assuming you have a legal entry into the US and have a expired I-94 in your possession.
 
Sorry! one more thing! I take it you are suggesting that I do not need to contact NVC at all at this point? Or would they already be awaiting an immediate reply?
 
Make a copy of everything as the original expired I-94 needs to be filed with the AOS (I-485) forms.
Once in possession of the receipt of I-485 (2-3 Weeks) filing make a info pass and let them deal with NVC directly.
You may also file for a work permit and advance parole for travel (if needed) with the I-485.

I Am in the United States and Would Like to Adjust My Status. How Do I Do That?

When a visa is available for your petition (or if the Department of State believes that one will be available in the next several months), the NVC will send you a letter asking what you plan to do. If you respond that you plan to adjust your status, the NVC will hold your file until a USCIS office requests it. If you do not reply, after 30 days, the NVC will begin processing your petition.

Requests for adjustment of status are processed by USCIS not by the NVC. You should contact the USCIS office nearest you for adjustment of status information.





So I guess you can call them so they will hold your file before they start processing it.

You don't need to deal with the NVC. Once you file the I-485 and associated paperwork (I-864, I-765, I-693, etc.), USCIS will automatically (but not necessarily immediately) talk to the NVC to prevent them from sending your file to the consulate, or to transfer the file back to USCIS if the consulate already got it.

Jack is right, but it just might be a little quicker rather than having to have the file sent back to NVC and then USCIS.
