This is my situation. Im a Candian citizen.
I moved to California back in June 2006 and received my temp residency card based on marriage to a US citizen. Before our 2 yr term passed, we seperated, I returned to Canada and we filled for a divorce. That was in July 2008. Our interview would have been in Nov 2009 to grant me my permanant green card. I didnt think much of it as I didnt want the green card anymore. I thought my file would just be closed.
Life passed and i have been in Canada ever since, but last week I tried to go to the US and was refused entry due to a Notice to Appear was on file. Apparently they sent the NTA to my old address in California, my Ex accepted it, but he never sent it to me. My court date is scheduled for sept 16th in LA, but im here in Canada.
Is there any way I can avoid going to the court date by sending proof of me having left the USA? Or is the best option for me to just fly out there for the hearing and proove to them that I voluntary left and turn in my temp green card?
Also, I my 13 yr old daughter has a expired temp green card, but she doesnt have a NTA on her file. Should she come with me to court?

Any help would be so appreciated, i cant seem to get answers anywhere!
