i had filed for i 539 as i am on h4 in march 1st week and i received a receipt number on march 22 ..
after that on april 2nd i filed for h1 and on april 13 thats after the random selection process i got a mail from uscis

Application Type: I539, APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS

Current Status: We mailed you a notice requesting additional evidence.

what does that mean and i have not got any mail form uscis till now nor my attorney has got any mail ..
my doubt is .. is this any thing related to my h1 or related to h4 status

thank you in advance

My guess is that ur H1B petition got selected in the lottery and since you have applied for a change of status to H-1B, they want some evidence that you will be maintaining a valid status till october 2007 ( H1B start date). Since it looks like you have currently applied for a H4 extension, you can produce the receipt of having filed for an extension. That should be enough evidence.
Anyway confirm the same with your lawyer...and CONGRATS for having won the lottery !
btw, was urs regular or premium processing , masters cap or general?

The guess above is highly inaccurate.

USCIS has yet to issue any receipts / approvals etc. on cap subjected applications post the lottery. The I539 is most likely related to your previous application.

This is a much more plausible explanation, and as much as people here would like to know the result of the lottery, it simply hasn't started to arrive as of today.

alex2d2, you are wrong.

Visit murthyforum on murthy.com, you will find tons of people in the general (non-master's) category who have received their receipts after the lottery and quite a few people who have even received their H1b approvals. The only consolation ( at least for me) is that they are all premium processing candidates. The general category, regular processing people haven't got any info yet as far as I know.

Bluemoon is wrong

Bluemoon,

You are wrong. USCIS will not give RFE because of H1 being applied. They will not mix two applications.

Usually on H4 you can get RFE asking to prove that H1 holder is maintaining proper status. Either Paystubs or a letter from employer will do. Or they may want your Marriage Certificate and etc if you have not provided one. Do not worry, this RFE will not be related to your H1B application.

Only Premium Processing H1Bs are getting Receipt Notices quickly. Few Non Premiums got it and it is slow. It may take one or more weeks to give receipt notices for all Non Premium cases.

Cbalas: You did not get my point

Cbalas,

If the H4 holder's I-94 expires before the H1b validity date ( 1st october), USCIS will issue an RFE if it is a COS ( change of status ), unless the person has shown proof that an application/approval for extension of H4 status has been made with USCIS. To prove this, a receipt from USCIS will do.
