USCIS recently issued an NOID letter on my employer's ability to pay. USCIS initially issued an RFE asking my employer to provide tax returns from 2001 (PD) to 2006. He provided everything up until 2005 but since he hadn’t filed tax for 2006 yet, he couldn’t provide the tax return for that year. All these tax returns from 2001 to 2005 show more than enough profit for my sponsorship, so there is no issue there. However, the USCIS is insisting that 2006 tax return or annual report or audited financial documents should also be submitted; otherwise the case will be denied. It is a small retail company and does not have annual reports or audited financial statements. The employer does not think that he could be able to file the 2006 tax before the NOID deadline although he made enough profit in 2006 as well. Has anybody been through the similar situation? Any help or suggestion in this matter would be much appreciated.
 
Your company has to write a letter stating why they did not file tax for the 2006. Send it it with the bank statement and your paychecks. These prove are ok. Good Luck!!!
