A quick history of my situation. I am an American citizen. My wife is from Lithuania and entered the country in 2002 under a J-1. We were married in 2005 and applied her citizenship. We divorced in 2006. We remarried in 2008. We notified USCIS of the new marriage. They said there was no problem. We went to the last interview and thought everything was ok and that she would receive her green card. Earlier this year, out of the blue, we received a notice from USCIS informing us that her entire application was denied because the application was made under a different marriage even though it was between the same two people. We have reapplied sending in an entire new application last month. She already has a stamp and has completed the biometrics for the new application. We are also expecting our first child in three weeks (Oct 24th). There is nothing else to this case. No felonies or misdemeanors, etc
Earlier this week we received a Notice of Hearing in Removal Proceedings on the old application and she is scheduled to appear on Nov 30th in Atlanta.
Questions:
1. With the new application underway and a child due any day just how worried should we be?
2. Is representation needed for our case... (I am sure the answer is yes, but I'll ask anyway)
3. Is it as simple as explaining the situation to the judge and showing him/her the new paperwork?
4. What can we expect to pay for services in regards to the removal proceeding? Yes, I know it varies just looking for an idea.
5. Any other big pitfalls you can help us avoid would be greatly appreciated.
