I just received a Notice of Findings from regional DOL office stating its intention to Deny my Labor application. The application was filed under RIR in July 2001. The DOL has asked my company (a Software firm) to provide documentation regarding layoffs at the company from my occupation of Software Engineer. Has anyone else experienced this? Do you know if people are getting their Labor approved after their companies respond to such a Notices? Or does this mean that chances of getting Labor approved are remote?
Is it possible to refile the same Labor application under a non-RIR category? Is there an advantage to doing so?
