hello every one , today i have a friend that told me about is situation and i feel so sorry for him because he got played by a fake lawyer that didn`t even told him that he received a letter of removal a year ago under a political asylum case that he had back in 2000 . Now he got is daughter a USC who filed up the AOS package for him and his wife while in the united states a year ago also but he still had his other asylum case . His wife after aving sent every requested document to the uscis has been granted the GC , she didn`t went to interview they sent it directly in the mail ; but his case has never been touch since march 2004 . he had a employment authorization since march 2004 and filed for a renewal this year and never had an answer . He called his lawer today and ask him to investigate what is taking the USCIS so long to approuve his i-485 case , but the lawyer told him instead that he has something important i wanted to discuss with . The lawyer told him that he had received a order of removal letter giving only 150 days delay of stay in the USA for him . The worst he didn`t even know about it . The letter was dated since december 2003 . I would like to know if there a possibility for him to still obtain the GC ? please i would like to know if something is possible...

Since his USC daughter already filed for his AOS last year, that should still be valid. What is the status of that application?
Also, Ask your friend to fire that lawyer and get a good competent immigration lawyer.
I don`t know for the status of the new i-485 ....
I beleive that the status of the new i-485 case is still pending .the last message it post over the internet for more then a year is that they received the fingerprint results and the case have been resume . since then nothing else not even the renewal of his work authorization card has been aprouved yet . Very strange .

I think this part of lawyers can help your friend at the end says what he can do if the lawyer messed up everything!

About the case,so that means when her daughter filed for him he was already on removal proceedings? because the order was back Dec 2003? I think what can be happening now is that they are looking to his case and now is that they will find about the removal proceedings BUT the removal is in base of his asylum case, not on his family based so I think that would be the difference.
I have found many cases of denial in asylum cases and people get in removal proceedings but until that I didn't find any further in a case like this.
Good luck, but keep the hope I think his case is pretty particular.
