I have a question regarding H4 Approval petition. In Nov 2005, I changed company in USA. New Company applied for my and my wife's visa transfer and extension. In March, I received my Notice of Approval (I-797) but my wife's H4 notice of approval got lost in the mail. Last week I requested USCIS to send it again but they said it will take another 3-4 months.
As my old visa is expired, I am planning to go for H1 and H4 stamping to Mumbai Consulate in month of Jun. I have been told by my company that for H1 and H4 staming in Mumbai consulate I dont need my wife's Notice of Approval. They said as long as I have my I797 i.e H1 notice of approval. it is sufficient.
Is this correct? Can I go to Mumbai consulate with H1 I797 only and get my H1 and my wife's H4 visa re-stamped?
