My 140 and 485 were concurrently applied on July 2004. On Feb 2005, I received this mail:
"On February 11, 2005, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283."
Neither I nor my attorney received this RFE. We waited for 14 days and called up NCS. Soon enough, I received this mail update:
"On March 4, 2005, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283."
Again, we did not receive anything from CIS. We called them up after 30 days only to find out that they cannot put in another request until May 3rd. That is because once they respond (which they did on March 4), they can't check again for 60 days.
We made another inquiry after 60 days (May 2nd). On May 19th, the 140 and 485 cases were denied as the INS did not get the request for evidence to us and since they "did not get our response" the adjudicating officer denied the cases.
A motion to reopen was filed and the case was reopened. A few weeks back, I received another mail update with this message:
"On November 30, 2005, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283."
This was exactly the kind of mail that I received on Mar 4th. It has been 2 weeks now and we have not received this elusive RFE from CIS.
I don't think that CIS has a wrong address of my attorney as we received the case denial mail!
I have no hopes that either the RFE or their response is ever going to reach us. I am only hoping that this does not repeat like how it did earlier this year.
My attorney tells me that there is nothing we can do but follow CIS policies of waiting till the deadline and calling up customer service. I don't think that will work out as it never did.
Has anybody in this forum been in such a situation where they have not received the RFE ? Is there anything that either I or my attorney can do to resolve this rather frustrating issue ?
Any advice/help/suggestions will be greatly appreciated.
