I am working on EAD with company B. Infomed GC sponsoring employer. He is ok with it. As mine is a future employment GC application. As i work 40 hours a week with company B. I dont get paid by company A. What i was wondering is should that be ok or should i use AC21 and join Company B as employee.
Keeping in view AC21 memo which says one need not actually work for GC sponsoring employer as long as both the parties had intention of employment at the time of approval. I guess even if one does not get paid by the GC sponsoring employer it should be fine, however if they show the intent. In my case i already worked for 3 years for the GC sponsoring employer.
Any thoughts from you all will be highly appreciated.
