Not filing I-140 and I-485 Concurrently

Guys;

My lawyer says for Indians I-485 can't be filed till PD is current. So they won't file I-485 and I-410 concurrently. Is this true?

what is your PD ? depends on that. nothing to do with indians or pakistanis.

When you are silently suffering in BEC, things have changed a lot. If you have time please go through the postings in 485 interim relief thread.
 
I am still pondering with what indian_gc_ocean is refering to?. Tried to search the thread he/she is refering to, but couldn't find specific one. :confused:

Agree the current cut-off date is 01/03 ... which hasn't moved since last 4-8 months. :mad:

What I was referring to is that recently there was a discussion to allow people to file their 485s when their PD is not current (if everyone can file 485s then there would not be this discussion) in thread I pointed out. Don't worry you should be able to file your 485 in FY '08(current FY'07 year is untill Oct '07).
 
Thanks buddy for cheering me up... 2008 is just around corner. By the way I was oblivious that their is going to be no further movement of PD till Oct'2007. So shall I stop reading the www.state.travel.gov monthly love letters (aka visa bulletins). :)
 
I am thinking that certainly there will be movement around April/May this year but it will into 2003; I am not sure how much movement its going to be before going unavailable. Since uscis is clearing all the 2001 and 2002 PDs now, it will be easy to work on just 2003 cases in 2008. Before the end of '08 we can start seeing 2004 PDs. Its just my opinion, as usual new regular(old PD non-RIR) labors from BECs and other factors can change the situation. Atleast it is not as complicated as having to consider 245s like eb3.
