Non-RIR at BEC

I applied for labor in Sept 2003 in CA regular (not the RIR route). My lawyer tells me today that the estimate of 2 yrs for backlog elimination applies to RIR cases only, and regular (non-RIR) may still take 4 yrs or so. Has anybody else heard this? Any semi-definitive estimate from any source on this?

Also, can I reapply under PERM and keep my priority date?
 
I am in the same situation

Non-RIR filed from CT in Jan 03. Any idea when it will come up for review?
