Hello,

I had F-1 visa refusal under 214(b) about 12 years back in India. Now I hold UK passport and in the last 3 years or so I had traveled to US many times under visa waiver program. During these visits I didn\'t disclose about my prior visa refusals on the I-94W form.
Now I want to apply H-1 visa at the embassy and I have a concern on how to answer the question about prior visa refusals on the visa application.

If I disclose about prior visa refusal correctly, will I have any problem since I didn\'t disclose properly on I-94W forms before?

If I do not disclose the prior visa refusal, will this be classified as misrepresentaion and result in any visa ineligibility?

I am in a fix as to how to proceed.
Will consul find out about my F-1 visa refusal from 12 years back? Someone told me that 214(b) refuslas are purged within 2 years from their system.

I was hoping for some comments on this situation.

tell the truth

it is safer to presume they have the full record available. If they know and you do not tell, failure to tell will have more negative impact than something 12 years old.
