Cuban Adjustment based Pending I-485, needs to travel.
My boyfriend's son entered the US with a B1/B2 visa on Aug. 2004. His I-94 expired 2/2005. Although the child is not a cuban citizen, the father is, so based on the Cuban Adjustment Act of 1996 (CAA) he can get the same beneftis than the father. Based on this act, the person must stay in the US for 1 full year before being able to apply for an I-485.
We filed the I-485 on 10/2005 and it is pending.
The child needs to travel overseas this year, and we'd like to know if he can (note that his I-94 has been expired for a year) and if we need to file for Advance Parole.
