Non-availability Marriage Certificate

Hi,

Can any one please let me know if they are familiar with the format of Non-availability of Marriage Certificate.

I dont have marriage certificate from the Govt.Registrator office but i am trying to get a non-availability certificate but the Registrator office is not willing to give Non-availability certificate as they are saying they never issued non-availability certificate like that.

Please anyone help me with the format of non-availability certificate with the Section name.

The Indian Govt. Registrator office need our physical presence to get the marriage certificate but I can't visit India right now to get the marriage certificate because I am in 7th year H1 extension and more over I sent my passports for visa revalidation.

And I came to know that Non-availability is the only way that you can produce as evidence.

How about if you got remarried here. I know this might sound crazy but I certainly would look into this solution.

No offence but I see that you have lived in US too long...
I know of people who got their marriage certificate/birth certificate etc reissued without even thinking about going back to india... I hope you got the hint.
 
How you got your Spouse here ? was he/she in any other status other than H4 ?. If you are a christian, then you can request your church to send you a letter and you can go to a local church here where you are registered and pickup a marriage certificate.

Else, pay some money and you can get it done. Money will get you anything....

You can get a marriage license here, its not that expensive and its pretty simple.

You can also state that, you married religously (hindu / muslim / any other religion), submit few photos, an affidavit by your family / friends and get it notarized and submit in the Indian court, if registors office doesn't accept it. You should get it in 3 months.

If you want your marriage certificate for your 140/485, don't worry about it and submit other papers, may be use the letter along with photos and notary. Between you can get it from india or wating for an RFE...there are few cases which got approved without a marriage certificate.

When my wife went to chennai consulate office (This is back in 1998), the consulate did not ask for marriage certificate but asked to provide evidence such as marriage photos and wedding card and she got H4 approved. I'm a christian and i do have marriage certificate issued by the church but I heard rumors that INS is not accepting marriage certificate issued by churches rather they need Govt issued.

Then don't you worry. As per Indian Law, Religious Marriages are as good as Government Registered Marriages. Hence you can submit your wedding card, couple of photos, Church certificate, notarized letter from witness and request to register your marriage in india. As I said earlier, if registar office refuses to get your application, then you can file at the court and they will issue within 3 months.

Other option is take the church certificate and get a certificate from local church and get a marriage license here @ united states.

If I was you, I wouldn't even bother about getting a marriage just for this purpose and I will just use same documents which you used to get H4 and probably an letter explaning the same to USCIS.

But FYI....its always better to have Birth, Death & Marriage certificate. So get it for other purposes too
