Hello,
We went for my wife's interview at Chicago INS a couple of weeks ago (I already have my GC from one year ago).
The officer looked at a lot of documents and then saw a photocopy of her certificate of non-availability (presented it along with the affidavits from her parents).
The officer asked for the original of the non-avail certificate and I could not find it - nor could my lawyer in his files.
So the officer issued us an RFE for the original and gave us 2 months to submit it.
The officer said that my wife was approvable (stampable) on the spot - but because of the non-avail cert she cannot stamp her passport.
My question:
I'm having a new original FedEx'ed from India now. I was only able to get one original. What happens if I mail the certificate to the Chicago INS and it gets lost (Chicago INS is infamous for losing documents). Can I mail a notarized copy of the cerfiticate? Is a notarized copy as good as the original?
Any information on this would be very helpful. Thanks.
