NOID - Need some urgent help

Need some urgent help..

Self & my wife got NOID ( intent to deny) letter for not appearing for my second FP which I never recieved.

I have changed my address in November 06 and notified BCIS of new address and got confirmation too.

I got NOID letter today to my new address but again I never recieved FP notice.

I have 30 days to respond from 5/22 to NOID.

NOID says "Unless you demonstrate that you missed this appointment though no fault of your own, your application will be denied"

Could you help clarifying the below:

1) How I can demonstrate that I didn't get a letter?

2)Any other steps I should take apart from responding to NOID? like taking an infopass appointment, calling CS etc.?

3) My wife is currently in India ( my bad she left only last week), so to respond to NOID for her application she should be present in US?

4) Whether she can come back on valid Advance Parole without any immigration issues?

Do not worry. You will be fine. Your attorney just need to inform the USCIS that you never received any FP notice. Was your case transferred from Vermont Service Center to Texas Service Center? When was your LUDs? Do you have an attorney? If so, the attorney should reply to it.

Answers to your questions:
1) How I can demonstrate that I didn't get a letter?
Ans: Talk to your attorney and explain to him that you did not receive any Finger printing notice. If you have your first finger printing notice .. you can send a copy saying that you received it and also appeared for it, but did not receive the second one and hence did not appear...

2)Any other steps I should take apart from responding to NOID? like taking an infopass appointment, calling CS etc.?
Ans: I don't think infopass appointment or calling CS would be of any help

Ans: Talk to your attorney and find out..
4) Whether she can come back on valid Advance Parole without any immigration issues?
Ans: Yes she can came back to US without any immigration issues.

yes. my case is transferred from VSC to TSC. LUDs were on 5/7, 5/8 & 5/22 but no change in msg.

Today I called up Customer Service and could get hold of a service rep ( could an immigration officer) she was very kind and understood the problem quickly and said she would issue another FP notice to the same address (which is correct) and advised me to go for a walk-in at ASC. Also she said she would send an e-mail to the officer who issued the NOID about the situation.

But probably I will have to respond to that NOID anyway..

Hope this helps others who are in same situation..

Can some one share a EVL template for a RFE?

Should the skills be part on EVL?
The job title and skills should match with the labor certification?
