NOA with a Fee Waiver Request

Hi all,

This seems like a nice community, and I see that there's a lot of people like myself, who are adjusting status from F-1 :)

We filed AOS on August 16. We have requested a fee waiver, because there's no way we can handle these fees :( We haven't received a NOA yet, so I'm just wondering - how long does it normally take to get a NOA if you're requesting a fee waiver (or, at least, to get the package back if the waiver is denied). Has anybody had a similar experience? I would appreciate any input.

I don't really remember all the details because my husband setup and sent application in. I know he wrote a cover letter explaining why we needed a fee waiver. He also sent our bills (rent checks, utility and other bills) and pay stubs where was obvious that we were not able to pay the fee. I think you have to proove that you are unable to pay, otherwise you will get rejected.
I am not a refugee.
I don't think this has anything to do with I-864.
My impressions is that these things aren't related at all.
It's not the same officer who determines fee waiver request and processes our application as far as I understand because fee waiver decision has to be made by supervisor.
Anyway, our RFE wasn't because of the fee waiver but because we didn't sent pay stubs and employer's letter with the application. We did send them with the fee waiver but forgot to send with the Affidavit of support.

why utilities bills were sent with this request? don't you think they will think that if u have money 2 pay all these bills then why can't u pay fee for immigration beneft?

why do u think fee waiver request has nothing to do with I-864? don't u think they would question how a sponsor will sponsor an alien if that person doesn't even have money to pay fee? one of the grounds to deny AOS is public charge and filing this request already proves that person will be very much public burden??

though same officer won't make a decision on aos but everything is on record and in file.

can you try to ask yr hubby to give all detail of fee waiver request?

I did answer. He did extensive (but read EXTENSIVE) search before sending everything in. Without utility bills and pay stubs fee waiver cannot be approved. A person needs to proove that it would be a financial hardship to pay the fee and immigration has a discretion in waiving the fee to accomodate the needs of individual/family. Our situation substancially changed since then. Back then we had one job, now we have two and I got a raise in the mean time. Our income at the time was above povery level but not enough to pay the fee without financial hardship (we live in a very expensive city) and those factors, among others are considered.
Regarding letter, it was a very short letter stating that we could use the fee waiver because of our financial situation at the time. We sent pay stubs and our bills to proove our claims.
Obviously, immi officer though we were not BS government so he decided to approve our request.
I really doubt Tim would come here (he has a thing against message boards) but I'll ask him.

Fee Waiver

You should never reveal personal identity here. If you felt as if u qualified for Fee Waiver, then u had every right to request it. I am glad u were granted it. U said ur husband did extensive research, then u should know that when the application is originally submitted, it goes to the department that will determine if Fee Waiver request can be granted. Then it is forwarded on. It appears as if yours was accepted and ur process has begun. Good luck and BE Patient! Everything will work out fine.
