No proof of legal entry

Hello All,

Here is my situation... I entered the country with my mother at the age of 10 with a border crossing card. Our passports were not stamped, but we were given a i94. My mother misplaced the i94 a couple years after. I am now 28, married to a US citizen with two children. I went to see a lawyer to help me obtain my green card but have no proof of legal entry. All I have is the passport I had back then and a photocopy of my border crossing card. We filed a FOIA to replace the i94 but my application was denied, I just recieved the denial letter today.
I just spoke to my lawyer and he said he can go ahead and file for my Green card and hope that with the photocopy we can still get approved. Has anyone been in a similar situation and been approved?
My fear is that they will deny it and I can get deported.
