No priority date on 485 797

I refiled 485 after a previous denial due to abandonment. I am using substituted labor and my own approved 140.

My 797 notice for 485 does not show any priority date. It is blank.

Is that an error ? Do I need to get it rectified ?

My priority date of Labor was mar 2000, so shouldn't the priority date on 485 be the same ?

I am not sure about 485 PD....

but when one files I-140 / I-485 concurrently....the I-485 notice surely won't show the Priority Date ....as the PD is only assigned/shown on the approval notice of I-140..

Since you filed after your I-140 approval...not sure ...in that case, if I-485 receipt notice would show the PD...

Overall, I would say - not to worry....U could always call USCIS and ask them about I-140 approval and enquire about the PD....

I once called USCIS and enquired about I-140 approval and a friendly rep did confirm my priority date on the I-140..

The priority date on 140 approval is correct.

My case is tricky because my earlier 485 was denied, so i am concerned whether they have carried over the priority date onto the new 485 or not. A# and all other information is correct.

pirate99,

I had an earlier 485 but it was withdrawn..

Our current 485 was for a new employer and new labor. However the attorney used the old priority date to allow me to file the 485. This 485 also had a blank priority date - just like yours.

A few months ago I called TSC to confirm they had the correct priority date. I was really polite to the person on the other end of the phone and they were polite back. I was told the priority date was from my old approved LC.

So give them a call and confirm they have the correct date. Be polite and you should get the answers you need.

When you are porting a date or using a substitute labor, the priority date will not be available on your 485 until the porting/substitution is done(means 140 is approved). Don't worry about it.

If you have applied 485 after your 140 approval(ported/substituted) then your priority date will be available on 485.

hope this answers your question.

Thanks
Ven
