Hi Friends,

Is there any limit (percentage, ratio, etc) for a software consulting/development company to have non-immigrants (H1B visas). Also, is there any restriction to have min number of Citizen/GC holders in a company.

Any links/resources would be helpful :)

No limits are prescribed.But if H1s in a company(depending on ratio of
H1bs/total eompoyees)exceeds a certain limit,the employer is termed as
H1B dependent employers and they have an addtional 'attestation requirments'.
H1b Dep. employer details:
The employer risks becoming an "H-1B dependent" employer if an employer hires too many H-1B employees.

Employers are considered to be H-1B dependent if they fall into any one of the following three categories:

1. An employer has 25 or fewer full time employees of which more than seven are H-1B employees;
2. An employer has between 20 to 50 full time employees of which more than 12 are H-1B employees; or
3. An employer has more than 50 full time employees of which 15% or more are H-1B employees.
