No.of Employee in I-140

Hi All,

My friend got his Labor approved and now is ready to file for I-140. Now there is a question about number of employee. At the time of H1 there were 23 employee, because of the slow down in IT industry now they are down to 5 employee and 2 of them are on H1 including him.Could this be a problem? The company is doing good now and they may hire few employee in near future.Can INS know if they mention no.of employee more than what they really have ?

First, don't lie.

Second, you can't lie about employee #. Too many factors are inter-related and you will sure get caught.
 
About 3 years ago I read a quote on this board that was extremely appropriate. I have used it several times since.
