No more iEADs in local offices through InfoPass!!!

Hi all,

I went for an InfoPass appointment at San Francisco last Friday, and was hoping that I could get an interim EAD, because my I-765 was filed more than 90 days ago and I have not received anything.

HOWEVER, I was shocked when they simply handed me a notice and said that local offices will no longer process any EADs and interim EADs after Oct 1, 2006. They told me that there is nothing local offices can do except submitting an inquiry for my EAD application.

I am wondering if anyone else is in the same boat, and if there is anything else I can do. This new policy means that we will have to wait and wait and wait, even if the normal processing time for EAD has passed - is that right?? :(

Thanks in advance.

If you already know about this, I would like to learn from you where you got this kind of information. With this lesson learned, I desparately want to keep myself informed at all times! Thanks....

This is really bad news.. What is your next step going to be? Where can you file inquiry for EAD? Did the immigration officer tell you anything?

U can call the customer service (800) 375 – 5283 and start a "procedure", don't know exactly how they call it. Basically, since ur EAD wasn't issued withing regular processing time you can file some sort of a claim over the phone. Your local office than becomes liable to get back to you with info about your EAD withing a month. Just talk to a customer service rep.

I have already done that on 8/30 for 765, but I have not got any info back as of today...Seems this "procedure" over the phone does not help much... :(

pankajkandhari, no, the officer did not tell me anything - just said she has called and made an inquiry about my EAD application. They are still processing and I "should expect EAD in the mail". But who knows when that will happen...

Do u still have H1B visa? U can still work if your visa is valid I believe.

Yes. Unable to obtain an iEAD successfully, I now am planning to extend my soon-to-expire H1B. Extra time and effort, less assurance...

Anyway, I was just very surprised to learn about this policy change when I got to my InfoPass appointment -- thought it might be good to post here so that more people can know about it and possibly exchange ideas/thoughts.

So what happens if your H1-B expires and you still donot have your EAD? Are you still eligible to work after your H1 expires and are awaiting decision on EAD / I485? I am soon going to be in the same boat as my H1-B expires in few months and haven't recieved my EAD yet.

OMG, that's the worst news I could ever hear...

It seems to me, that they're just making this process more and more complicated. There were times when you had to submit your paperwork in person, and they issued you an EAD the same day. And now we have to wait for God knows how long... :( It sucks!!!

I think as long as you file your H1-B extension before the H1-B expiration date, you can continue working. It does not take much effort to file an extension -- the law firm that handles cases for my company could do it in a few days.

I thought after you have 6yrs H1 time, you cannot file for H1-B extension under family based GC processing unlike employment based GC processing.
