NO Labor pending and 6 Years are over..

Hi,

Thank you in advance for reading and replying to my post. Here is my gory story.. Please help...

6 years on my H1B are completed by April 11th 2004.

Left US to spend one year outside, - on April 11th 2004.

Now,

can my new H1B filed before spending complete one year out side US?

If it can be, When can be it filled ? Meaning is there a time frame to file H1B before the start date of the requesting visa period ?

Ca my employer request for LCA for future (Approximately 6 months in advance of the employment start date ) ?
