Hi guys,
I filed my I-140/I485 concurrently after labor cert approved in may 2005, based on 245 (i) . I- 140 was denied because of ability to pay. so I- 485 closed. Ref to I -140 then approved on April 6, 2006. My priority date is April 17, 2001. My I-485 reopened immediately but my wife I 485 remain closed. I called USCIS, they said send a copy of my I 140 approve. I did. nothing changed.My FP completed on April 14, 2006. My wife received neither I- 485 reopen nor FP appointment. Our EAD is in the process of renewal.
Any one encounter this kind of situation and please let me know what to do.
We would like to apply advance parole to see our parents. It has been 14 yrs.
Could we eligible to get advance parole and it is even save to travel out side of US before I 485 approved and with the record of immigration violation ( out of status ) in the past.
