No Birthcertificate for uneducated Parent - Need Affidavit procee Help

My Father does not have birth certificate and not gone school. But we got passport 15 yrs back not sure what process we did to get birth date on passport. But I-130 approved last week.

We also hire lawyer in India to get birth certificate but it will take long time and not sure we will get it. But I am reading on http://photos.state.gov/libraries/mumbai/395145/pereirals/IV-Infosheet-PK3.pdf and got secondary evidence to get in place of birth certificate.

1> Can someone give me format and what needs to be written on stamp paper. and details of stamp paper (Amount , Type.. etc..) it also mention sworn before a First Class Magistrate what that means ?

By googling I got some sample but I need to get feedback who really done this process.


2> Who ever relatives(How Many relative required ? 2, 3, 4..) I am getting for my father to sign on affidavit they do not know English so will it ok if I get stamp paper in English or I have to get native language ? I may get relative they do not even know how to read native language? So what can be done ?

If a birth certificate is not available, a letter form the registrar of births is required stating that a birth record is not available. That letter should include your father's name and his parents names.
This letter along with notarized affidavits and other secondary evidence (any government document issued sevaral years ago with his name and date of birth like voter records, bank account information, voter registration, etc.) will be acceptable in place on actual birth certificate.
You can search this forum for affidavit formats. Which country are you from?

I thought non-availability letter and 2 person notarized affidavits will be enough for birth certificate but do I still need to get other secondary evidence (any government document issued sevaral years ago with his name and date of birth like voter records, bank account information, voter registration, etc.)

I have my father voter records and bank account. I know voter id just show the age not birth date. But bank account might show birth date.

I am from India and my father is from Gujarat(India).
 
It is good to have additional documents for secondary evidence, older the better. You might want to email Mumbai consulate to see what other documents might be required. I am assuming that your father will apply for immigrant visa in Mumbai.
 
I called laywer who is helping me on birth certificate. I asked him I need affidivate prepare which should be sworn before a First Class Magistrate but lawyer mention affidivate prepared by notary not First Class Magistrate.

is anyone has done affidivate in Gujarat ? please help me on this.
