I was on an H1 with company A till sept 2005 and transfered to another company B in October 2005. I started working for them but my h1 transfer went into RFE.
But I moved to another company in April 2006 with the receipt notice and my old company B didn't respond to the RFE or pursue it further.
Now I am applying for GC as a dependent (my husband is primary). The law firm is asking for my second company's approval notice which i never got.
They are saying the USCIS may consider me out of status for that time period since I don't have an approval from them. But as far as I know, you are still in status if you have a receipt notice - am I right? Plus I had a valid H1 stamp in my passport - it expires end of this year.
I'm worried now since the lawyer said it might be a problem. Does anyone know how this works? Am I considered out of status for that time? (I have pay stubs from Nov '05 - april '06 time period).
