No Advantage in CP Filing

CP Processing in NSC takes 8 months more time than AOS.

After approval another 6 months for sending packages etc...

So totally 14-16 months duration for CP with travel.

However, AOS is less than 24 months without travel.

So INS pushing us towards AOS i Guess.

Guys please look into this aspect before going for CP.

cptracker.com seems to be averaging 6-8 months from the time of I-140 approval, about half of your predicted time.

I can't see the BCIS pushing towards AOS when the State Dep't handles CP. They can't handle the workload they have, why would they want more?

I agree that, once I140 is cleared BCIS will not come into picture. But, evidence shows that 140 (CP) takes 8 months more than AOS(I am a victim). My Early April CP case is still pending. But, for the same RD, concurrent AOS EB1 (OR) got approved during August-2003 end.

Why this different approach by BCIS?

I don't mean to be a smartass, but your post does not make any sense. You seem to have your petitions mixed up. There is no way that AOS is proceeding faster than CP. You seem to be saying that I-140's are being approved faster because they are being reviewed during the initial I-485 screening. There is some evidence of this but it is far from routine. I am seeing I-485 processing times hit 3 years now (after I-140 approval). Just imagine if Congress passes some sort of guest worker program. There will be *MILLIONS* of extra petitions to be processed with no extra staff.

We've been through the CP vs AOS thing before. True, concurrent filing does not make CP a slam dunk anymore, but a lot can happen in 3 years while you wait. JMO.

If you happen to see Excel sheet, many of non-concurrent cases and CP cases are waiting for more time (Atleast 6 months gap). Right now, NSC processing Aug-2003 cases (Concurrent). But March 11 Non - Concurrent cases are still pending.

I would like to know the reason behind this.

There may not be any way to prove this partiality. But, the reality is important.:o
 
Brian is correct. In general, the initial approval of the I-140 petition appears to be faster for the concurrent filing. However, the CP is still faster than AOS once the underlying I-140 has been approved. Nevertheless, both CP and AOS have their merits depending on individual circumstances.
