Please correct me if this interpretation is wrong. After reading about concerns of several self-petitioned people, I tried to do some research:
NIW according to recent NYDOT criteria requires:
1. Substantial intrinsic merit
2. Intended area of employment has national scope
3. Your individual benefit etc etc
When 140 is approved, you have proved the three criteria. for eg. an environmentalist studying contaminant in air has substantial intrinsic merit (point 1). It has also been proved that your benefit outweighs labor cert/job offer (point 3). So as long as you are an "environmentalist" then one should not be bothered about layoff/changing jobs because your ability for points 1 and 3 have not changed.
Regarding changing jobs: since point 2 indicates that your intended area of employment has national scope.....then should it matter if person takes a job in a similar area in a different part of the country. because :national scope means can be done from anywhere.
Therefore for self-petitioned NIW if there is a layoff and they have to take up jobs in a different part of the country.....there should not arise any problem since essentially all three criteria are automatically satisfied with point 3 absolutely not changing (person doesn't change) at all and point 1 and 2 satisfied by similar job.
