I did a self petition in NIW category, Nebraska Service Centre. INS receipt on April 09, 2006. I am a research associate. My area of research is Virology, Antiviral, Vaccine Development and Structural Biology, have a Ph.D with several publications and awards.


Received and RFE, January 26, 2007 with a deadline of April 20, 2007.
The RFE is attached in a word (doc) file to help others.

Sent my response yesterday April 18, 2007 to NSC. Answered each and every point in a six page response letter, point by point and submitted substantial proof for each (I made a big mistake here, I undermine myself, I think I should have done EB-1A, now too late :( )

My questions are the following:

1. How long does it take for a decision ?
2. Whether still it can be denied ?
3. If denied what is preferable to appeal or go to EB-1.

1. I do not know generally how long they take. In my case, the RFE response reached NSC on 20th and I got the denial letter (faxed) on 22nd. If an approval, I do not know how long it takes.

2. I hope not, NIW should be OK. I might have been worried if it were an RFE response to an EB1-EA at NSC.

3. Appeal is a long process, mostly we losing the case. I think go for EB-1. I am also in similar field. If you feel you have a strong case, go for it.... DO THE E-FILING... so that your case goes to TSC to get a fair judgment. You will know the decision (if PP) far earlier than you would if you appealed your NIW case.

Response to the above rfe was approved in a week. This was a self petition case. Thanks to all for support.
