NIW RFE - Please Help

Hi All,

I had applied for NIW in Aug 2000.

I got an RFE asking to submit an original Labor Dept Form ETA 750 Parts A & B. I did submit ETA 750 Part B when I applied (one copy). I didn\'t submit Part A as this is an NIW application.

I am totally confused with this RFE. How many copies of ETA 750 Part B do INS need - one or two. Can somebody please help me out. I would greatly appreciate any help/suggestions from people who have applied for NIW. BTW, the center is VSC.

Hi,
It is my understanding that TEA 750 part A is to necessary if your employer is the "Petitioner".

TEA 750 part I is enough if your NEW application is "Self petitioned" by you or some one has
petitioned on your behalf (not the employer).

Yes, I remember reading that, two copies of TEA 750 part I are to be submitted.

If there is any argument on your application referring to the current employment and/or
that you would continue with the current job, then I believe, INS expects TEA 750 part A --
then comes the "tests" of NY DOT !
