NIW or EB1 application

Hello folks,

I am new in the GC application and want to get some helps from you. Currently I am holding Post-doc position in JHU hospital. I have 8 papers (5 first author, 3 second), just submited one recently, and have a few citations: under 10. What is your suggest for my GC application? I heard that if I filed I-140 or I-485 together, and first step fails, I die, is that right? Any ideas are welcomed. Thanks in advance!!!!!!!!

It depends on your area of work. If you can effectively prove that what you are working is critical for national interest, then have a good chance filing NIW. I guess you are not from a retrogressed country (India/China). You got it right on concurrent filing.

Thank you for response. Actually I was from China and currently I am doing bioinformatics computation. So you mean it is not a good idea to file together if I am Chinese? Please give me more suggestion if you can. Thanks a bunch!!!
 
Sorry to break the news but China is subject to retrogression, as are many other people in different categories There are many threads on this forum relating to this as many people are affected. You cannot file the I-485 until there is a visa number available to you. Below is the website for the department of state visa bulletin which is issued monthly. You will see the employment based categories and the priority dates (the date you first filed your application; I-140 in your case). This month only if you filed on or before May 1 2000 can you file the I-485.

Your qualification is o.k for both but unless you explain your story well i see bleak chances. For EB1 post doc word might harm. publication list is alright but need to show impact of research thru other means as citations are less. outstanding letters and awards can have beneficial effect. Essentially you nee dto read a lot over net about EB1 to get staright. About I-485 as being from china ............you cannot file I-485 now may be in few months if it gets current u can file semi concurrent. About EB2 NIW i guess you have ti prove national impact very well.
