NIW (NSC) Approved after one year

Hi,

I got the magic e-mail from CRIS today informing my I140 NIW petition was approved. What a relieve after waiting for almost a full year. It's just too bad that I cannot file I-485 since I am from a regression country. I am preparing to file EB1-EA soon.

I've learned so much from this forum and I thank all the folks here who shared their experience, knowledge or simply encouragement. Here is my qualification when I filed NIW a year ago.

Engineering PhD from a US university.
15 Journal papers and 20 conference papers (mostly first author) with about 40 citations.
One international graduate research grant award, one best student paper honorable mention in an international conference, and a college wide award.
Reviewed 10 papers for four international journals
8 reference letters from government agency, industry, US and foreign universities.
About 10 media stories about my research, most of them were centered on my adviser with the exception of one which did mention my name.

Do you work for a company or academia? I remember reading something about you getting an RFE requesting an employer name....

And your signature states that it took you almost 2 months to respond to that RFE... Did you give them more than they asked for?
 
I work in the university. You are right on my RFE. It was about providing information about proposed work in the I-140 and it turned out to be a very trivial one.
 
Thanks. In my case, I am about to start working for a company (and put that down on the I-140 form) but I read recently that it's hard to get NIW if you work for a company because you'd be working in the corporate interest and not the national interest. I don't know how true that is, but it makes me nervous.

I am no expert on that. But my lawyer told me that normally this information is not required with his experience of filing tens of petitions. Actually, you can just put in the proposed work field you are going to work in if you don't have a job at the time. My guess is that it shouldn't matter that much.

Congratulations! Your name sounds exactly the same as my old friend's first name. I guess you are from China. I am so happy for you!

Most people from retrogressed countries apply for EB-1 EA/OR based I-140, even after their EB2-NIW case was approved. Your credentials are very strong and I think you should waste no time applying for EB-1 EA. Good luck!
