Hi Folks,
Happy Thanksgiving
This if my first time come to this forum. I submited a NIW last December, and got RFE letter on June 29, 2005. I responded to the RFE on September 20, 2005, and got a letter of denial on November 5.
I am planning to file a Motion to Reopen and Appeal, but I do not know what is the difference from this two? My understanding is that if I state I am requesting a MTR/Appeal, then the VSC would review it at first, then they would tranfer to to AAO, is this right?
Also, what fee should I pay, the $385 fee for both, for I need to pay additional fee?
thanks in advance for your advice.

Appeal is for I-140, and MTR is for I-485.
I never filed MTR but I filed appeal for my denied I-140 and it was approved at AAO. See my former posts for info on appeal.
You have only 30 days from the date of denial to file appeal, I think appeal should reach them within 33 days from in your case Nov 5, if you got denial by mail, they give those extra 3 days for mail delivery.

How long did you wait for the AAO decision?

Hi,

How long did you wait for the AAO decision? My EA case was denied recently. I am thinking to appeal or not. Thanks!

Generally it takes 3-5 months!!
Pl read AAO decisions on NSC site before preparing response!!

thanks

thanks, compass. I have not come back to this forum for a while since I did not get any response after I posted my initial questions while the deadline for submitting my appeal was due. I have submitted my appeal on dec 02, and nothing happens yet.
happy new year!

Happy New Year to you, too!
Be patient now, just wait.
I think, Service center will transfer appeal to AAO in approx one month after they receive it, in your case maybe later due to holydays. And then another 6-8 months of waiting...
