NIW I-485 RFE (employment letter)

(I-485 RFE): USCIS requested an employment letter which must also indicate whether the terms and conditions of your employment-based visa petition (or labor certification) continue to exist.

My case is based on NIW.

What is the point to answer this question? Thanks a lot.
 
They are checking the status of your employment, if you are still employed by the same company with an adequate salary, etc. I got this request in May, submitted RFE in June and never heard back from them since :confused:

Hi,

Did you also submit a letter from your employee when you submit your original 485? I also got an RFE but I still haven't received the letter so I don't know what they're asking. I wonder if it will be the same as you two and I also wonder if this is NSC's way of "killing time" and pretend they're working on our cases!

Receiving RFE could mean that USCIS is really working on your case! I received RFE for my I-485 petition based on EB-2 NIW I-140 approval. Surprisingly, USCIS asked if I was still working on the NIW field and requested that I provide an emplyment letter along with recent publications.

I replied to RFE early September 2006 and got an approval email in 10 days. If your visa is available and the name check is cleared, it is likely that you would get approval quite soon. I wish you the best!

Now, wouldn't that be awesome??? :D My problem though is that they haven't even sent me a fingerprinting request! So, even if this RFE is employment based I can't really foresee an early aproval like yours! :( But, it does show that they are indeed working on my case already! I still though have the feeling that this RFE could be related to my request for employment authorization, as it came just a day after I applied for i765 online! Well, I should be getting the actual letter sometime this week as they say it was mailed 10/5.

It usually takes about a week to receive the RFE letter in the mail. For the fingerprinting (FP) issue you have, you should call 1-800 number to complain about no FP. Please read below for the details of my case. Take care!


----------The Timeline
04/01/05: I-140 EB-2 NIW Filed (NSC; South Korea).
07/29/05: I-140 Approved.
08/19/05: I-485 Receipt Date.
02/01/06: Code-3 Fingerprinting (LUD:02/02/06 with no message change).
07/21/06: Called USCIS to ask about I-485 status (NSC was processing November 2005 applications at the time I called).
07/31/06: Received a letter from USCIS that mentions “pending officer review”.
08/14/06: Received a RFE letter: (a) Prove that you continue to work in
the NIW field and (b) provide all the documentary evidence for non-immigrant visa status.
09/09/06: Replied to RFE.
09/18/06: Received an approval email.
 
Thanks. I called and all they can say is that it may take up to 6 months for them to issue FP request! :eek: I'll keep on calling...
