NIW help needed NSC (degree related)

Dear Friends, I submitted my I-140 and 485 petition to NSC on Sep. 23, 2005. At that time, I did not have a Ph.D. diploma, but I finished all the requirements on the Ph.D. program. So, I have the university written a letter saying that I finished all the requirements and will get the degree in October (degrees are conferred only three times a year).

Today I received an RFE asking for a Master's degree otherwise I may not be considered to be eligible for the application. The mean that I need an advanced degree before the date of application (Sep. 23, 2005). Unfortunately, I don't have a Master's degree.

Do you have any suggestion what I should do? I am planning just mailing my Ph.D. degree once I got it. Or should I withdraw the I-140 and 485 if the outcome is absolutely an rejection.

Go ahead and submit your Ph.D degree/letter by the RFE reply cut-off date. You get around 80 days to reply. So you should have your degree by then. Also, its too late to worry about the degree not being conferred by the application date. The adjudicator might even overlook that fact which in my opinion is minor since you're getting the degree/letter just over a month after you turned in your application. In any event, you've paid the application fees so why waste them?
 
I think in some cases, exprience can be used to prove

your excptional ability. If you have 10 years of exprience, maybe you can add that in the letter.
