Niw Got Rfe Need Help

HI EVERY ONE

I got RFE. It says you meet all the requirments except one.

Made a reference to NYDOT appeal, why USA interest adversely affected if not going through labor certification.

If any body know the answer, Please share information.

NYDOT has been discussed ad nauseum on this message board. Please read the whole thing.

You have to show that the US would be hurt if you had to go through the LC process. This is not a trivial thing to prove and you should proceed carefully. There is no easy answer. Failure to address this properly will result in a rejection.

I am shocked that NIW applications would go in today without addressing this point (especially if you retained an attorney).

My NIW RFE questioned about labor cert., too. In fact, my petition (so are others, I beleive) addressed a lot on it. It seems mine is worse (see Bad NIW RFE?), asking many details. Any idea?
