NIW case, spouse no job, risk for approval
Hi, Folks:
My case is a NIW case, but my spouse is laidoff. We are scheduled for interview. I am worried if this situation will affect our approval. Anybody knows spouse's paystub is asked during interview? Also, I changed job recently from uniersity to industry, but stayed in the same field. I was told a job change from university to industry is at high risk, any body has similiar situation? please help. Many thanks

no problem

everything will be about you however make sure that you also have an affidavit of support made out for your wife. this way she will not be a public charge in the eyes of the officer.
your job change does not matter as long as its in the broad area of what you were doing. thats what niw means..(technically waiver of job offer)
as always may i request you to post your experience after the interview is done.
too many filers on the board disappear once done with their interviews.
Thank you.

ag28,

I have the interview in 2 weeks (NIW). I haven't changed job or title. I have the I140 approval notice.
Is there any "job offer waiver " that I need to take to the interview. I think some one mentioned about it.
I did not get any such letter from my attorney. Can you please tell me. How does the Ins will know about my field of
work as it is not mentioned in the I-140 approval letter.
Please reply.

there is no waiver offer letter

your case is simple as you havent changed jobs unlike many people here. just get an updated employment letter, copy of the entire petition that you filed (the local office will also have the copy with them). They know whats going on based on your 140 petition. so if its the same job, just the employment letter should do.
for people who have changed jobs, then maybe something like what is NIW may be needed in case the officer doesnt know it.
good luck. Just hope that all checks have already been done.

Thanks for the info. I will post interview experience when it is done. my iterview will be on May. Do u know how to establish that u are still in the same field, or anybody whoever went through this?

thanks ag28.

needluck,
I think we may have to take all the research publications if any and the emp letter with the
title. I think, if they ask anything we may have show our publications/other materials if any.

This is my most recent info

Hope it helps
my colleague with an approved NIW (university in Texas) moved to an eminent univ in Boston in 2003. Had already filed 485 in late 2001. Files transferred to local office (bos). at interview only simple questions asked as to what research he is doing, etc. He had just a job letter mentioning duties. Point to note: not much significance attached to change of jobs. and also not too many other job questions.
everything was okay except that a couple of papers were missing from the file (probably not transferred from original office).
everything else was alright and they would get approval once the papers come.
Best wishes to all on the forum.
