NIW at VSC : let's face it, it's hopeless

I140 NIW at VSC : the sad truth :

june 2003 : processing cases received before May 18, 2002
march 4, 2004 : processing cases received before June 26, 2002

can anyone give me a single good reason to still believe that my case, submitted in august 2002, will ever be processed before i die ? in these forums you can find people who have applied two years ago and have not received any news ! you call the national "service" center and they ask you to be... patient ! yeah, 19 months is not long enough for them. is there any US citizen abroad who had to be so "patient" ?

now there must be spider webs in my files. my resume has been eaten by mice. the forms have turned yellow. a bird has made a nest with my certified copies.

calling my lawyer ? all he knows is what i see on the USCIS website. useless. and if a miracle occurs, you have to wait two more years for your I485. depressing. absurd. unfair.

i give up. what a pathetic waste of time and money. i pity anyone who still hopes his case will ever be processed. and don't give me this ridiculous "call you representative" stuff. do you think they care for people who cannot vote ? or the "ask for an inquiry" stuff. like a foreigner has the power to start an "inquiry" in a US government agency. what a joke.
 
Your feelings of hopelessness are completely understandable.

What is especially difficult with the NIW (and with EB1) is that the processing has essentially been at a standstill. It would be very different if there had at least been a steady trickle...that way we would have some sense of what the pace is, and when our applications are likely to be processed.

Obviously the standstill cannot remain forever. My belief, although I have no basis for it, it that we will, at some point, see a flurry of activity on NIW and EB-1, with a very rapid catchup. You know, something like a whole six month block being processed rapidly.

The unknown is when that time will arrive. VSC has stated that once it has stopped processing H1-B1 applications, resources will be moved to I-140's. My hope is, at that point, that the Director will say, "OK, it's time to catch up on NIW/EB-1." I think it is a fairly small number of people that adjudicate those applications.

You know it HAS to happen. There is the presidential plan to have processing down to 6 months by FY2006. That is going to mean higher fees, but it also means that we are NOT heading towards a 5 year processing time for I-140s.

In the meantime, rely on the fact that there has not been a fire at VSC, and so your NIW is in fact there, and it WILL eventually be addressed.

Feel for me. For most people, having the EAD is fine. For me to be appropriately licensed, I actually need a greencard. I think they generally don't feel a huge rush for these things, as they generally believe that whilever you have the EAD, you can work. But it is not always true for NIW and EB1...sometimes for licensing, and also for federal funding through NIH etc.

I am on the same boat as you. every time cis posted the new processing dates i checked it with hope but the dates never changed. now i lost hope.

you can go to uscis website --> feedback --> comment on immigration procedures and email them your complaint on this. i did this several times. since NIW and OR are a small pool it is very hard to get their attention. but i think it is harmless to give a try.
 
I understand your frustration. My case was approved last month. It was submited in July02. Hang on there!

IT IS NOT TRUE THAT EB1 OR NIW PROCESSING IS AT STANDSTILL.

I beleive (this can be checked by scanning) that most of these cases dating from 2002 have been already processed.

There are numerous examples that people from this category get I-140 approved in 6 months and 485 approved in less than a year and a half.

Why did some people got stuck? Reason is the unjust random processing policy.

Why they did not move processing dates - this is beyond understanding.

I agree that the delays of some applicants are caused by randomness. but i check with my lawyer and he told me that he did not receive any NIW approval with ND after June, 2002. as to the scanning results, most of the approvals you mentioned are probably for EB2 (non NIW) or EB3 (can you tell whether a case is OR or NIW based on scanning results?). NIW and OR got stuck is a fact that affects many people around me. the processing dates are not precise but it does give you an idea on where they are.
