Hi all,

My I-140/NIW was approved yesterday. It was filed Jan 29, 2004 at VSC. I called the 800 number for NSC on the day that my processing date had already gone more than 30 days over past my RD. I received an approval 11 days after I filed a complaint of not having received a decision on my case. I also had filed an EB-1/I-140 petition which was denied in Dec, 2004 for which I filed an appeal.

I am currently on an F-1 (student visa). I am a doctor from India, currently pursuing a Ph.D. in Pharmaceutical sciences at the National Institutes of Health (NIH). At the time I filed, I had 5 publications (2 first author) and only 4-5 citations in mediocre journals. I personally thought that mine was a weak petition and would never be approved. But, I filed in both EB-1 and EB-2/NIW categories just to give it a try. I had submitted only 5 letters of recommendation from people who worked with me directly, all bigshots at the NIH though.

I was thrilled to see the approval e-mail from USCIS this morning. Going to file I-485 now, as I didn't file it before because of my F-1 status.

Thanks for your help everybody.

The credibility of your references mean everything. Congratulations.
