Kind of jealous of you ! You filed your NIW case at CSC. not like some of us, i.e. TSC, long waiting time. I am also working in Energy & environmental area, with very strong background though. Hope TSC would work much faster in the near future, because BCIS change their review policy all time time.

Just want to know if you used any DIY kit to help you, like one from www.greencardapply.com or you do it totally by yourself?

To answer the above questions...

1. I applied for GC all by myself, but following a DIY package can be a practical way.
2. I filed my I-140 first. I-485 is still in my hands.

First, I can share my thought, but I am not responsible for any possible consequence.

I think it is not easy for F-1 to get I-140 approved unless you have a good fit into the catorgory you are going to apply for. From the info I collected from the internet / consultant, applying for I-140 usually does not affect H1B because H1B allows you have immigration intention. However, NOT all lawyers agree that I-140 denial does not have negative impact on OPT, which is based on F-1 student status.

2. Working on several federal projects . This fits well into National Interest.
3. Publications: Not many.
4. Strong recommendation letters from various sources (unversities, federal government, national labs, big companies and international organization)
5. Excellent presation of the case.

I got RFE from VSC. the officer is making a reference to 1998 NYDOT appeal i.e that the petiitioner must established that national interest of the United States would be adversely affected if laor cert. were required for this beneficiary.

Could you please help, where i can find references to make a proper reply thanks.

In my RFE, there is a secion called Advisory Opinions. What I did was just following that. FYI, in my RFE, NYDOT was also refered to in detail (one FULL page- every aspects of NIW was covered), but the RFE did not ask me to provide additional evidence for all that explicitly in the Advisory Opinions section. So, what I provided was based on the Advisory opinions ONLY instead of addressing all the NYDOT issues. Additional evidence can also be provide if avaiable.
