NIW approved, but...

Hi all,

My EB2 NIW petition was recently approved by NSC. However, there is a problem of my approval notice. The case was filed as self-petitioned. But my employer was printed as the petitioner on the approval notice and I was listed as beneficiary. I didn\'t get any sponsorship from my employer for this case, I don\'t know why my employer was listed as the petitioner. I thought all the NIW cases are supposedly self-petitioned before. It seems that I am wrong. Does anybody have the same problem before? How did you fix it? Is this going to affect my I485 filing? Thanks in advance!

Congratulations. I also filed an EB2 NIW with NSC (on Feb 27), but was issued (on 4/16) a RFE listing
the 7 general requirements of NIW. I filed as a beneficiary with my boss/university as petitioner.

My case was approved without RFE. I only received an approval notice. It seems to me that INS was very general in your RFE. It will be easier to deal with it if they specify their requirements. From my experience, the ref. letters and if your work is truly of national interest are the two important things for INS. To be safe, it is always good to file LC or another category with your NIW.

Could you tell me why you filed your NIW using your boss as petitioner? Did your boss/university provide any documents for your case? Is there any advantage of filing this way over self petiton?

Hi,Gua,

I have been doing a contracted project from the department of energy.
I think it\'s more reasonable to ask my boss(the university) to
be the petitioner. At the time of filling the I-140 forms, I also noticed
the INS new statement of the purpose of I-140 on its downloading web
page. The drawback is that you have to maintain good relationship with
you current boss until the end of the whole process (because he is the
person the INS corresponds with all the time).

I prepared everything all by myself, and the 7 requirements were not
explicitly addressed in the cover letter. I have to do that in the RFE.
Can you give me more details about how to address these issues

Could you list what the 7 points are. I am preparing NIW (self petition). Do I need include any job offer (I have) or supporting letters from my current employer? Thanks
