My H1-B Visa expires Dec 2008. I am about to apply for GC under NIW category. I have over 5 years of experience in power system engineering research at a reputed university.
Summary:
1. MS in Electrical Engineering
2. Pursuing Ph.D (part-time)
3. Currently involved in DOE and NSF projects
4. In the process of filing 5-6 patents (2 filed till now)
5. 5-6 very strong reference letter, 2 from same institution, 2 from outside collaborating institutions, 2 from industries directly benefiting from the technology
6. Above letters focus on my critical role in developing a new technology to improve power system reliability (avoid blackouts like NY, saving lots of money in maintenance costs etc), present successes of the technology and future commercialization goals, unique skill requirements, my experience and knowledge in this narrow field since its inception.
7. Two requests to review publications (not very strong)
Negatives:
1. I don't have any publications, solely because of proprietary reasons and since they are in the process of being patented
2. I do not have a Ph.D degree yet
3. Even though I play a major role in the DOE and NSF projects, I am not directly named in the proposals (does this matter if the PI says I am involved?)
Questions:
1. Will it be difficult to qualify for NIW?
2. Do I need to mention any where that I am not able to publish because of proprietary reasons? (may be in on of the reference letters too)
3. Do I address the third prong by stating that my area of research is unique and very new (evidenced by my patent applications and sparse prior art) and most of the experience was gained on the job and there is 'no one out there' with the required knowledge?
