NIW appeal sent back from AAO to VSC

Can you please help!!
My NIW I-140 was denied by the vermont service center about a year back. I appealed it and the service center forwarded it to the appeals office (AAO). Recently I checked case status online and it stated: "... On Nov 28, 2005 we transferred your I140 IMMIGRANT PETITION FOR ALIEN WORKER to an office in VERMONT SERVICE CENTER for processing. Our office in VERMONT SERVICE CENTER will send you a written decision as soon as processing is complete..". Now I suppose that means the AAO has made a decision on the petition. Does the fact that it has been re-sent back to the vermont service center an indication that the petition is approved? or is this a regular part of the appeals process where no matter what decision is taken by the AAO (denial/approval), it is sent back to the service center before the petitioner is informed of the decision

I guess the AAO has not made any decision. They just rebound it back to VSC to frustrate us further.

My case of NIW appeal has been pending in AAO for over 8 months. I am wondering how long your case has been in AAO before it was sent back to VSC? Has you received any decision after your case was sent back to VSC in last Nov? I am so depressed by the endless waiting.

It's a normal process. AAO has made the decision of your appeal, not I-140. It's the VSC's job to process your I-140. It seems that you will get results soon. Good luck.

Could you please say a little more? Do you think the VSC can make a different decision of the I-140 from the AAO decision on the appeal? Thanks

VSC has to obey AAO's decision of appeal. If appeal is successful, your I-140 is reopened. But that's not the end of processing. VSC still need to finish the rest. If they find other problems, they still can deny these cases. Of couse, that's rare. But technically, it can happen.

Have you ever made an inquiry to VSC about your case? If it says your case is transferred to VSC on Nov 28, 2005, you should be able to make the inquiry now. Half year has passed.
